INTRODUCTION: Women s rights in Bangladesh have been an issue for decades. Women are deprived of their basic rights in almost all spheres of life only on the basis of that they are women. The image of discrimination is seen regardless of their social, economic and religious status. Bangladesh has generally been quite successful in formulating legal measures to combat social ills against women, for example in areas such as domestic violence, violence against women and children in general, dowry, etc. through enacting different laws Women and Children Repression Act 2000, Anti-Dowry Prohibition Act 1980, Cruelty of Women Law 1983. Unfortunately, the same cannot be said of family laws. However in this case a Muslim woman has the option to repudiate the marriage upon reaching at the age of puberty. A Muslim male can contract va lid marriage with a Muslim as also with a Ketabi (Jew or Christian). But his marriage with an idolatress will be irregular. On the other hand, A Mulsim woman may not contract a valid marriage with anyone else but a Muslim. A marriage with a Christian or a Jew would be irregular while a marriage with a Hindu would be invalid. As regards marriage, limited polygamy is allowed for Muslim husbands, Women however are prohibited from polyandry. As far as registration is concerned, Muslim family law ordinance 1961 made the registration of marriage compulsory. On the other hand Marriage under Hindu law is essentially a sacrament and not a contract. Hindu marriage is solemnized in accordance with the customary rites and ceremonies which differ from cast to cast. However, it has been established by the Supreme Court of Bangladesh that for the validity of a Hindu marriage, only two ceremonies are absolutely essential. These are (a) Invocation before the sacred fire and (b) Saptapadi. Since it is not a contract, ordinary legal principles regarding contracts are not relevant, such as the minimum age for marriage.
